Hyundai / Kia Class Action – Quebec

This proposed class action alleges that Hyundai and Kia continue to manufacture, market, and sell vehicles with a defect found in the brake system located in the engine compartments of these vehicles that was also found to exist in previous models, the Electrical Fire Defect, and failed to inform and protect consumers of the risks that this defect presents.

What is this lawsuit about?

On June 2, 2022 Slater Vecchio filed an application for authorization to institute a class action in the Quebec Superior Court for alleged violations of the Quebec Consumer Protection Act by Hyundai Auto Canada Corporation and Kia Canada Inc. in relation to a defect found in the brake system located in the engine compartments of a number of these vehicles that was also found to exist in previous models, the Electrical Fire Defect. 

This potential class action seeks to represent all individuals in Quebec who purchased or leased one of the following vehicles: 

  • Hyundai Azera 2016-2011 
  • Hyundai Elantra 2007-2010 
  • Hyundai Genesis 2015-2016 
  • Hyundai Sante Fe 2007, 2016-2018 
  • Hyundai Entourage 2007-2008 
  • Hyundai Tucson 2014-2021 
  • Hyundai Sonata 2006 
  • Kia Cadena 2017-2019 
  • Kia K900 2016-2018 
  • Kia Sedona 2006-2010 
  • Kia Sportage 2008-2009, 2014-2021 
  • Kia Stinger 2018-2021 
  • Kia Sorento 2007-2009, 2014-2015 
  • Kia Optima 2013-2015 

This Electrical Fire Defect is alleged to expose individuals in the above vehicles to an unreasonable risk of harm, injury, and property damage. 

Who Does This Class Action Represent?

This action is brought on behalf of all individuals in Quebec who purchased or leased one of these vehicles.  These individuals are referred to as the proposed Class Members.
