Pedestrian

As pedestrians we are protected by the rules of the road. Drivers must yield the right of way to pedestrians in a crosswalk.

City streets are very busy these days leaving little room for cars and pedestrians to interact and share the roadways. A simple thing like crossing the street, as routine as it is, can be tragic if the rules of the road that protect us are not followed. Our children and senior citizens are at the greatest risk of injury.

Pedestrians are struck because drivers fail to see them. Other common causes of pedestrian accidents are due to drivers who:

  • Drive without the proper care and attention
  • Fail to observe posted speed limits
  • Disregard weather or traffic conditions
  • Disobey traffic signs or signals
  • Fail to yield the right of way to pedestrians at marked cross walks
  • Fail to come to a complete stop at a stop sign
  • Fail to stop before turning right on red at an intersection
  • Drive while under the influence of drugs or alcohol

Here are some examples of trial awards Slater Vecchio has achieved for our clients in pedestrian cases:

  • Heringa v. Mah, 2000 BCCA 490
  • Kerr v. Paterson, BCSC 2007, M033506 (PDF 384KB)
